Modified Comparative Negligence

Texas personal injury laws operate according to shared fault, or modified comparative negligence, when issuing damage awards. This means that the total compensation a plaintiff receives may be reduced by any percentage of their own fault. However, if you have been found to be more than 50% at fault for the accident, you cannot collect any damages at all from at-fault parties.

For example, if you are rear-ended at a stoplight but one of your brake lights weren’t operating appropriately at the time, the court may decide you are at 20% at fault for the ensuing accident. If the total damage award was originally set at $10,000, you will receive $8,000, reduced by your 20% of fault.

Note that some states set damage caps, or maximum compensatory damages an injured person can receive. Texas, however, only sets damage caps on medical malpractice cases. Medical malpractice damages may include economic and non-economic damages (meant to compensate for the injured person’s pain and suffering and other intangible injuries).

Statute of Limitations

If you seek compensation for any injury you are suffering, it is important to be aware of the statute of limitations, or how long you have to file a case before the court will no longer accept it. In Texas, the statute of limitations to file a personal injury case with the state civil court is 2 years from the date of the injury. 

The statute of limitations is much shorter if you seek to make an injury claim against a government entity or employee. The statute of limitations in such a case is 6 months. The claim should address:

  • description of the damage or injury;
  • the time and place of the incident;
  • a summary account of what happened.
