Misdemeanor and Felony Assault

Assault is a violent crime that can be charged as either a misdemeanor or felony, depending on the circumstances of the offense. In the context of the law, Texas considers assault to be:

  • intentionally, knowingly, or recklessly causing bodily injury to another, including the person's spouse;
  • intentionally or knowingly threatening another with imminent bodily injury, including the person's spouse; or
  • intentionally or knowingly causing physical contact with another when they know or should reasonably believe that the other will regard the contact as offensive or provocative.

Assault that results in “serious bodily injury” or that involves a weapon is aggravated assault.

Generally, assault offenses are categorized into the following sentencing levels:

  • Class C misdemeanor – a person threatens another with bodily harm or causes physical contact in a provocative or offensive way, and no other aggravating factors are present
  • Class B misdemeanor – a person commits assault against someone who is a sports participant during a performance or in retaliation for a performance
  • Class A misdemeanor – a person causes bodily injury to another, and no other aggravating factors are present; or a person causes physical contact in a provocative or offensive way against an elderly individual
  • Third degree felony – a person commits simple assault resulting in bodily injury against a special victim like a public servant, security officer, or government employee in the performance of their duties; or a person repeatedly commits domestic assault
  • Second degree felony – a person commits domestic assault
  • First degree felony – a person commits aggravated domestic assault; or a person commits aggravated assault against a protected class member (public servant, security officer, etc.)

Drug Possession Crimes

Texas also seriously criminalizes drug-related offenses, from possession of controlled substances to felony marijuana crimes. Recall that federal law categorizes controlled substances (CDS) into 5 different schedules based on their dangerousness and potential of abuse, some examples of which include:

  • Schedule I – heroin, LSD, PCP, crack cocaine
  • Schedule II – morphine, cocaine, oxycodone
  • Schedule II, IV, V – drugs containing smaller amounts of certain narcotic and non-narcotic drugs like Xanax, Valium, and codeine in Tylenol

At the very least, possession is punishable by either a Class B or Class A misdemeanor punishable by up to 1 year in county jail and up to $4,000 in fines. However, an offense could be charged as severely as a third-degree felony if the defendant has high amounts in possession. Be aware that marijuana, a Schedule I drug, is punished under separate marijuana laws, which criminalize all forms of marijuana, from oils to edibles to vapes. Possession and distribution of small amounts are misdemeanors, but increased amounts are punished severely as state jail felonies or higher. The penalties also increase if the offense took place in or near a drug-free zone, such as a school, playground, or youth center.
